This is an example of a major difference between a republic and democracy. Remember under a republic the nation is under rule of law. Under rule of law the opinion or the political leaning of a judge would have no relevance. The judge would rule based on what the law said. A democracy operates on the basis of arbitrary law. The opinion or political leanings of a judge determines the ruling. The judge would rule with the majority or those in power regardless of what the law said.
Pennsylvania’s Supreme Court has a 5-2 liberal majority, so the court’s chances to uphold a lower court’s ruling are slim. This is the lead sentence that describes the situation in Pennsylvania today. Prior to the 2020 election, Pennsylvania changed who could receive a ballot by mail and vote by mail. The Pennsylvania Constitution says that mail in ballots can be used in specific situations and enumerated the situations. A pandemic, real or contrived, was not one of the situations. Under rule of law, the actions of the state would have to be rejected by a judge regardless of their opinion or their political leanings. Under arbitrary law, the judges could and would ignore the Constitution and rule based on the political leanings of the majority. Under rule of law, one can only arrive at the conclusion that the results of the 2020 election are unconstitutional. The massive fraud in vote counting throughout the country adds even more credence to the fact that the 2020 election was "the big steal." Elections like we had in 2020 are elections based on arbitrary law, or democracy. A republic would not and should not honor such a violation of law as has been honored by even the Supreme Court. This is why we were founded as a republic. Our founders wanted fair and transparent elections. This is why the American left wants a democracy, so those in power can determine the outcome of an election despite the will of the people.
