The federal agencies have been usurping the role of the legislature and the judiciary for many years. The Supreme Court has upheld that the executive branch agencies cannot make law when they write regulations. This is what communist dictatorships do, the executive of bureaucracy assumes the power of the legislative branch as well as the judiciary branch. Now, the Supreme Court has ruled that the bureaucracy cannot act as judge and deny the citizen of their constitutional right to a trial with a jury of their peers.
The rulings by the Supreme Court against the bureaucracy have favored the division of power as opposed to the consolidation of power. The left believes strongly in consolidation, but then the left has promised to transform the United States into a communist dictatorship. The ruling to protect the constitutional rights of the citizens was a 6 to 3 decision. Yes, the left-wing justices said that the 7th amendment and the rights of the citizens no longer exist, and the power of the executive branch must be supreme. The Supreme Court revoked the Securities and Exchange Commission’s (SEC) assumed power by invalidating the agency’s internal system used to seek civil fraud penalties. The 6-3 decision along ideological lines rules unconstitutional the SEC’s in-house administrative courts, a key tool it has leveraged in enforcing securities laws. The Biden regime stated such an outcome would threaten agencies across the federal government that use similar setups, or that such a ruling would hamper the transition to a communist dictatorship promised by the left. Chief Justice John Roberts, writing for the majority, said forcing defendants to go through the SEC’s in-house system rather than a federal district court violates their Seventh Amendment right to a jury trial, “A defendant facing a fraud suit has the right to be tried by a jury of his peers before a neutral adjudicator. Rather than recognize that right, the dissent would permit Congress to concentrate the roles of prosecutor, judge, and jury in the hands of the Executive Branch. That is the very opposite of the separation of powers that the Constitution demands.”
